Rule No. 1: Purpose

The general terms and conditions of sale described below detail the rights and obligations of the company Mimidoudou & Co and its customers in the context of the sale of the following goods: NEW OR USED TOYS AND STUFFED TOYS.

These general terms and conditions of sale are concluded between Mimidoudou & Co and any natural person ("You") wishing to make a purchase on the Website http://www.mimidoudouandco.com

These General Terms and Conditions exclusively govern your relationship with Mimidoudou & Co.

Mimidoudou & Co reserves the right to modify the General Terms and Conditions at any time. They will then be applicable as soon as they are posted online.

Any service provided by the company Mimidoudou & Co implies the buyer's unconditional acceptance of these general terms and conditions of sale.

Rule No. 2: Presentation of products

The characteristics of the products offered for sale are presented in the "Catalog" section of our site. The photographs are not part of the contractual field. The liability of the company Mimidoudou & Co cannot be engaged if errors have been introduced. All texts and images presented on the site of the company Mimidoudou & Co are reserved, for the whole world, under copyright and intellectual property rights; their reproduction, even partial, is strictly prohibited.

Rule n°3: Duration of validity of sales offers

The products are offered for sale until the stock is exhausted. In the event of an order for a product that has become unavailable, the customer will be informed of this unavailability, as soon as possible, by email or by post.

Rule n°4: Price of products

The "Catalog" section of our site indicates the prices in euros including all taxes, excluding shipping costs. The amount of VAT is specified when the customer selects a product and the shipping costs appear on the screen at the end of the selection of the different products by the customer.

Mimidoudou & Co reserves the right to change its prices at any time, but the products ordered are billed at the price in effect when the order is recorded.

The prices offered include the discounts and rebates that Mimidoudou & Co may grant based on its results or the buyer's assumption of certain services. No discount will be granted in the event of early payment.

Rule No. 5: Order

The customer validates their order when they activate the "Confirm your order" link at the bottom of the "Summary of your order" page after having accepted these terms and conditions of sale. Before this validation, the customer is systematically asked to check each of the elements of their order; they can thus correct any errors. Mimidoudou & Co confirms the order by email; this information includes in particular all the elements of the order and the customer's right of withdrawal. The data recorded by Mimidoudou & Co constitutes proof of the nature, content and date of the order. This is archived by the company Mimidoudou & Co under the legal conditions and deadlines; the customer can access this archiving by contacting the Customer Relations department.

Mimidoudou & Co specifies that the right of withdrawal (according to article 221-18 and article 221-28 of the consumer code) takes effect from the receipt of the package by the buyer. No order can be cancelled and refunded before the delivery of the package, even if the shipment has not yet been made. From the day of delivery, the customer has 14 days to change their mind and exercise their right of withdrawal via a withdrawal form.

Mimidoudou & Co reserves the right to cancel all orders without specific reasons, the refund will be made immediately after the cancellation of the order by Mimidoudou & Co on the customer's debited account.

Rule No. 6: Payment methods

Payment is made in full when ordering by transfer, credit card or PAYPAL.

Rule No. 7: Late payment

In the event of total or partial non-payment of the goods delivered on the day of receipt, the buyer must pay Mimidoudou & Co a late payment penalty equal to one and a half times the legal interest rate.

The legal interest rate used is that in effect on the day of delivery of the goods.

This penalty is calculated on the amount excluding tax of the sum remaining due, and runs from the due date of the price without any prior formal notice being necessary.

In accordance with Articles 441-6 of the French Commercial Code and D. 441-5 of the French Commercial Code, any late payment automatically entails, in addition to late payment penalties, an obligation for the debtor to pay a fixed compensation of €40 for recovery costs.

Additional compensation may be claimed, upon presentation of supporting documents, when the recovery costs incurred are greater than the amount of the fixed compensation.

Rule #8: Delivery and returns

The delivery deadline varies depending on their address. It is set, for an address in metropolitan France and abroad, on the day of payment + 30 days. Free shipping will ONLY be sent by Mondial Relay, the place of receipt remains at the buyer's choice.

If this delivery date is not respected, the consumer may cancel the purchase by registered mail with AR and must be reimbursed for the full amount paid. The Hamon law of 2014 established a maximum delivery period of 30 days from the date of online purchase, after this period no more claims will be accepted or refunded.

Mimidoudou & Co declines all responsibility in the event of loss, theft or breakage of the package by the carrier, in the event of breakage the buyer is obliged to check the contents of the package before accepting delivery by the carrier, in all cases no refund will be granted.

We undertake to post your package within a maximum of 3 working days after receipt of payment (except in the event of a problem with the availability of an item); for bank transfers, you must therefore wait until the money is in our bank account.

The products are sent according to your chosen delivery method: by post (colissimo, letter with tracking) or by international shipping (small tracked package or colissimo) but ALWAYS WITH TRACKING

We do not accept any cancellations of orders before sending, to do so you must use your right of withdrawal provided for by article of law L221-18 of the consumer code: Returns are accepted within 14 days from the date of receipt by the buyer (date of the post office being authentic), the receipt of the return must be made under the same conditions as the shipment, that is to say with tracking. A return request by email, tracked mail or via the customer area must be made before any return, specifying the order number and the date of purchase. Without this request Mimidoudou & Co reserves the right to refuse the return request.

The shipping costs to and from the destination and the bank charges related to the order remain the responsibility of the buyer unless there is an error by Mimidoudou & Co.

Mimidoudou & Co is in no way responsible for the loss or damage of packages by the carriers, in this case no refund or compensation will be granted but Mimidoudou & Co undertakes to take steps with the carrier for the reimbursement of delivery costs if insured.

PACKAGING CONDITIONS

Mimidoudou & Co carefully packs your packages in regulated shipping pouches, and protected with bubble wrap if necessary.

Rule No. 9: Customer Relations - After-Sales Service - Disputes

For any information, questions or complaints, the customer can contact the company's Customer Relations department from Monday to Friday from 9 a.m. to 5 p.m.

Rule #10: Satisfied or refunded

The customer has 14 clear days from delivery to make a return request by email, tracked mail or via their customer area and to return the product to us without any particular reason. The return costs with tracking are their responsibility. The product must be returned under the same conditions as for tracking. They will then be reimbursed for the price of the product within one month of receipt by Mimidoudou & Co.

Unless there is an error on the part of Mimidoudou & Co, the shipping costs for both sides will remain the responsibility of the buyer. In the event of payment by Paypal, the sales costs kept by Paypal will be deducted from the refund amount. However, products returned incomplete, damaged or soiled will not be accepted.

You must return the ordered product within 14 days of sending your return request letter by email to Mimidoudou & Co customer service (See Model below) the refund will be made within 14 days after receipt of the goods.

Rule No. 11: Return of Goods

All unclaimed orders (Post or Mondial Relay) and returned to the sender Mimidoudou & Co will be kept for two months (from the day of receipt) by Mimidoudou & Co. After this period, the items will become the property of Mimidoudou & Co and will be put back on sale

When you place your order, the personal data collected will be subject to computer processing.

Its purpose is to provide you with information about the usefulness and use of the personal data that we collect during your visits to our site, when creating your customer account, when placing orders, and when contacting customer relations.

Collection and processing of your data

Rule No. 13: Buybacks

Used/second-hand product refers to used products, already used by consumers or professionals, purchased as such by Mimidoudou & Co with a view to their resale on the website www.mimidoudouandco.com as a used/second-hand product.

We buy back soft toys or comforters in excellent condition, clean, without holes, stains or animal hair (a discount may be applied to the repurchase price if we find defects.

If some items unfortunately cannot be repurchased, you can donate them to our partner association.

The seller certifies that he is the owner of the item(s) sold and that the latter is (are) marketable on French territory.

Purchase protocol:

You contact our repurchase service by email with the photos of your items that you want to sell us (5 minimum) no maximum.

The repurchase service will contact you with a price proposal valid for 1 month within 3 working days.

If the quote suits you, we will send you a repurchase form and the Mondial Relay prepaid shipping slip.

The items must be shipped in appropriate packaging conditions, we decline all responsibility if your items arrive broken.

Upon receipt, inspection and validation of the products received, Mimidoudou & Co undertakes to pay the seller within 48 hours after receipt of the goods by any means, namely: Transfer or PayPal.
